    It may sound absurd. But President Obama signed a bill into law Wednesday that requires passengers who carry firearms aboard Amtrak be locked in boxes for their journey.

    It’s a mistake in the law’s wording. But for now, the clerical error is the law of the land.

    Earlier this week, Congress sent the president a massive spending bill that funded dozens of federal departments. Tucked into the transportation section of the legislation are safety requirements for Amtrak customers who carry firearms on board the government-backed train system. The bill Congress passed mandates that passengers with firearms declare they have weapons with them in advance and stow them in locked boxes while on the train.

    The bill text was correct when the House approved the legislation last week. The Senate followed suit Sunday, but somewhere along the line, the language that referred to putting the guns in locked boxes morphed into stuffing “passengers” into locked boxes.

    Aides to House Speaker Nancy Pelosi, D-Calif., became aware of the problem Wednesday night as the House voted on its final slate of bills for the year. Pelosi’s staff tried to negotiate with Republican aides to see if they would agree to change the text of the bill without revoting the entire piece of legislation. But it was all for naught as Obama had already signed the measure into law.

    It’s clear the typo alters the legislation’s mandate. But no one quite knows the origin of the mistake.

    Senior Congressional sources familiar with the error suggested the problem may have been introduced in the “enrolling” process of bills. Once both the House and Senate approve the final version of a bill, the text of the legislation is sent to an “enrolling clerk” who actually copies the bill onto parchment paper. The parchment version of the package is then sent to the White House for the president to sign into law.

    Another theory is that the mistake could be something as simple as a printing error. The House and Senate run multiple versions of bills before they send the final copy to the White House to become law. Another possibility is that Congress sent President Obama the wrong, non-proofed version of the bill to sign.

    The misfire is fixable. But probably not until early next year. The House late Wednesday completed what it expects to be its final session of the year. The Senate remains in session debating health care reform. But both the House and Senate would have to agree to a technical correction of the text that missed its mark.

    The law, though, states that Amtrak has six months to implement the policy. So it’s unlikely that any gun-toting passengers would have to travel in a box.

    The error is reminiscent of $289 billion farm bill President Bush vetoed in May, 2008. In that instance, both houses of Congress inadvertently sent Bush an incomplete bill, leaving out a 35-page chunk. The president then vetoed an incomplete bill. Congress discovered the error when lawmakers attempted to override the president’s veto.

    In that case, House re-passed the entire farm bill and overrode Bush’s veto.

    “This bill is one of the most-passed bills we’ve done,” House Majority Leader Steny Hoyer, D-Md., quipped at the time.

    The rules to allow Amtrak passengers to carry weapons with them are new. Airline passengers have long been permitted to transport weapons in checked luggage. But Amtrak banned firearms from its trains after Sept. 11. Only police officers are now allowed to board Amtrak trains with guns.

    Rep. John Fleming and Sen. Roger Wicker, both Mississippi Republicans, are the primary advocates of the Amtrak gun provision.

    President Obama and other world leaders attending the final two days of the climate summit in Copenhagen will experience some unusual winter weather. A blizzard dumped 4 inches of snow on the Danish capital overnight.

    “Temperatures will stay low at least the next three days,” Henning Gisseloe, an official at Denmark’s Meteorological Institute, told Bloomberg.com’s Christian Wienberg in a telephone interview on Thursaday. Gisseloe is forecasting more snow in coming days. “There’s a good chance of a white Christmas.”

    According to Weinberg’s report on the Bloomberg.com website, Denmark hasn’t had a white Christmas for 14 years, and there have only been seven in the last century. Temperatures today fell as low as minus 4 Celsius (25 Fahrenheit). The Denmark MeteoroIogical Institute defines a white Christmas as 90 percent of the country being covered by at least 2 centimeters of snow on the afternoon of Dec. 24.

    The forecast for today in Copenhagen is clouds and light snow with a daytime high of minus 1 Celsius and a low tonight of minus 7 Celsius. Friday’s forecast calls for sunshine, but temps will drop to minus 3 Celsius for the high and minus 12 Celsius for the low. The average high for this time of year in Copenhagen is 3.8 Celsius and the average low is 0 Celsius.

    For example, if your electric bill is $185.00 and your utilities have been decoupled, your actual bill would be more like $150.00. They want you to think you’ve used $185.00 worth but actually they’ve restricted your usage without informing you.

You are still paying for 70 degrees but your house is only set at 65. They won’t tell you they are doing it but I swear to you they are doing it. We’ll probably hear about elderly people that died in their sleep because of this.

    Harry Reid is now in full retreat mode, tail between his legs, as he is now actually hiding the latest version of the Senate Healthcare bill. As U.S. Senate Republican Leader Mitch McConnell points out today, “The final bill we’ll vote on isn’t even the one we’ve had on the floor. It’s the deal Democrat leaders have been trying to work out in private” he said. It’s why they want to rush the bill before Christmas. Which makes perfect sense when looking at the plummeting poll numbers.

    Another “Metered Service” Ripoff: Pacific Gas & Electric’s ‘Smart Meters’ Are ‘Cunning Little Thieves,’ Critics Allege

    When utilities want to “charge you for what you use,” it would be nice to trust the meter is accurately measuring your usage, California consumer advocates say.

    In a growing controversy, Pacific Gas & Electric (PG&E) is now being accused of installing so-called “smart meters” that were smart for PG&E profits, but financially devastating for California consumers who face higher bills and growing questions about just how accurate those “smart meters” really are.

    Customers across California who have had new meters installed, which are supposed to help consumers save energy by charging lower prices at off-peak usage times of day, report enormously higher bills from PG&E after installation.

    State Sen. Dean Florez, D-Shafter (Kern County), reports he has seen bills from customers that don’t begin to make sense.

    “One farmer was charged $11,857 for running a piece of equipment that was never turned on. A local attorney at the hearing clutched a $500 bill from July, a month in which she was visiting family out of state and almost every appliance in her house was shut off,” he reports.

    Florez quotes the woman — “My smart meter keeps reading these spikes in usage at noon. But no one was in the house,” she said. “It’s obvious to me that this technology is not ready for prime time.”

    Customers across the state with smart meters have reported similar stories, and are angry with PG&E’s response to their concerns, which can be boiled down to, “the meter is right, you are wrong, now pay us.”

    PG&E claims that during its own internal reviews, it found nobody being overcharged. Spokesman Jeff Smith says “in all 1700 of those cases we have not found an instance thus far of the smart meter transmitting inaccurate information or incorrect usage information.”

    The California Public Utilities Commission doesn’t think that’s enough and has begun ordering an independent review of the “smart meter” program and accuracy of meter readings.

    Liz Keogh spent 14 years collecting and analyzing data at the Institute for Social Research in Ann Arbor, Michigan, and now lives in Bakersfield, California. She has been pulling out her old PG&E bills and records showing her utility use all the way back to 1983. What she found since the “smart meter” was installed on her home was disturbing.

    The suspicion that funny business is going on might be justified when considering Bakersfield residents have been through this all before.

    “[Several years ago] Bakersfield is where PG&E first realized it had made a $500 million mistake, installing tens of thousands of inferior meters that would never live up to the promise. So the utility purchased a new generation of meters from Silver Spring Networks Inc. of Redwood City. PG&E insists that these new meters are glitch-free, though it concedes that it has tested only 50 out of 250,000 meters in Kern County,” Florez said.

    At a time when some broadband providers want to install their own meters to overcharge customers for their Internet service, the PG&E experience is telling. Independent oversight of any meter comes down to the enforcement mechanism available to guarantee accuracy. But broadband service in the United States is unregulated, and no such enforcement mechanism exists.

    And just when you thought you could believe the rhetoric that utility customers who conserve their usage will save more money, another electric and gas utility in San Diego filed a rate increase request that will charge customers who have managed to cut their usage even higher prices than those who have not.

    WASHINGTON – An animal protection group asked a federal judge Wednesday to block a plan to round up about 2,500 wild horses to remove them from a Nevada range.

    The mustang roundup planned for Dec. 28 would be one of the largest in Nevada in recent years. Federal officials plan to use helicopters to force the horses into holding pens before placing them for adoption or sending them to long-term holding corrals in the Midwest.

    Mustang advocates say use of the helicopters is inhumane because some of the animals are traumatized, injured or killed.

    The roundup is part of the Bureau of Land Management’s overall strategy to remove thousands of mustangs from public lands across the West to protect wild horse herds and the rangelands that support them. The bureau estimates about half of the nearly 37,000 wild mustangs live in Nevada, with others concentrated in Arizona, California, Oregon, Utah and Wyoming.

    Another 32,000 horses and burros are cared for in corrals and pastures in Kansas, Oklahoma and South Dakota.

    A lawyer for In Defense of Animals, a California-based group that advocates on behalf of animal protection, called the roundup plan illegal.

    “The BLM’s policy of mass removal and stockpiling of horses was never authorized by Congress when it protected these iconic animals in 1971 as an important part of our national heritage,” said William Spriggs, a Washington lawyer who argued against the roundup plan in court Wednesday.

    In Defense of Animals and wildlife biologist Craig Downer sued the BLM last month to block the Nevada roundup. Terri Farley, a Nevada author whose books about wild horses target young readers, joined the lawsuit Monday.

    Erik Petersen, a Justice Department lawyer who represents the BLM, said the roundup is needed because more than 3,100 horses and burros crowd the Calico Mountain Complex in northwestern Nevada — about five times as many horses as the land can handle.

    The 1971 law requires removal of excess horses to ensure they are treated humanely, Petersen said. Removing the animals also will help preserve the “endangered and rapidly disappearing” rangeland where they live, Petersen said.

    Interior Secretary Ken Salazar announced the mustang roundups in October as part of a new management plan he said would avoid the need to kill any wild horses. Interior Department officials had warned last year that slaughtering some of the 69,000 wild horses and burros under federal control might be necessary to combat rising costs of maintaining them.

    Salazar said the current program is not sustainable for the animals, the environment or taxpayers.

    The BLM’s wild horse program cost about $50 million this year and is expected to rise to at least $85 million by 2012 if the program is not changed, officials said.

    Spriggs, the lawyer for In Defense of Animals, said the BLM has only itself to blame for the high costs. At least two-thirds of the costs for wild horses are for long-term storage facilities in the Midwest that he said were nothing more than warehouses.

    U.S. District Judge Paul Friedman said he would rule on the case before Christmas.

    Like overly populated deer areas, the same holds true. It is best to get good riflemen who know what they are doing to shoot them so they won’t suffer. I have always been for that.

    They can still use the horse meat. There is a time frame within which they can get it preped.

    The White House announced the nomination of Mari Carmen Aponte last Wednesday along with a handful of other appointments. The selection has started to draw some attention given that former President Clinton nominated her for ambassador to the Dominican Republic in 1998, only to see the nomination fizzle after the foreign relations panel questioned her over her past relationship with someone who had apparently caught the attention of the FBI.

    One former official with knowledge of that nomination said the committee started scrutinizing Aponte after learning that she had attended a party at the Cuban mission to the United Nations in New York City, and that she had a relationship with someone, Roberto Tamayo, who had raised concern at the FBI over “possible ties to the Cuban government” and “repeated trips there.”

    The former official said the matter “sure as hell” should come up this time around.

    “I think it’s a mistake to have someone who did not pass muster before to be nominated again,” the former official told FoxNews.com. “It shows a disrespect to the process I think. … Hopefully there’ll be somebody on the committee who takes a sober look at the record.”

    According to reports at the time, a former Cuban intelligence agent also told a Spanish-language newspaper in Miami in 1993 that Cuban intelligence was trying to recruit her through her boyfriend.

    By the time Clinton nominated her, that relationship had ended — the former official said the Senate committee had no evidence of any such recruitment either. But the source said the committee was ultimately concerned about her relationship with Tamayo, and whether it could be exploited by the Cuban government.

    The Miami Herald reported in 1999 that the FBI had cleared Aponte of being targeted in any recruitment scheme. The Washington Times quoted a former FBI agent at the time as saying Tamayo was actually a valuable source of information for the FBI.

    White House spokesman Tommy Vietor cited the FBI’s finding in defending the appointment.

    “As has been previously reported, the FBI fully investigated this issue in 1999, and Ms. Aponte received a thorough background check by diplomatic security as part of the nomination process this time around,” Vietor said in an e-mail to FoxNews.com. “Had there been any doubt, the president would not have nominated Ms. Aponte to this position.”

    But the former official with knowledge of the nomination said Tamayo was probably not an FBI “mole,” and his contact with the agency didn’t mean he was innocuous.

    Aponte has been a prolific contributor to Democrats, including Secretary of State Hillary Clinton when she was running for Senate, and others. The attorney has an extensive legal background, having served as president of the Hispanic National Bar Association, as well as on the board of the National Council of La Raza and the Puerto Rican Legal Defense and Education Fund. She was born in Puerto Rico.

    Watchdog group Judicial Watch raised alarm over the appointment, but predicted that she will ultimately be confirmed.

    “It’s a challenging set of negotiations,” one top official said. “This is an on-going process. This is the 15th year of this process.”

    Obama’s trip comes as the U.S. and China took steps Thursday toward a broad agreement that could be sealed by Obama and Premier Wen Jiabao when they arrive at the flagging U.N. climate talks.

    But it remains to be seen what concessions Obama will have to make for the U.S. to seal the deal on emissions actions at the 193-nation conference.

    Secretary of State Hillary Clinton already announced the U.S. would press to raise $100 billion a year worldwide by 2020 to help poorer nations cope with global warming, and China offered to open its books on efforts to cut emissions.

    White House officials said they hoped the final result would be a so-called operation agreement — weaker than a binding set of greenhouse gas limits with measurable target dates but stronger than a political commitment with no underlying action plan.

    But there was no guarantee of this outcome due to differences between the U.S. and China over pollution limits and the ability of outside nations to verify compliance – an issue covered by the umbrella term “transparency.”

    Republican lawmakers were not encouraged by the developments.

    “Clearly, the things that are happening in Copenhagen run counter to what Americans want this administration to be focused on,” Rep. Steve Scalise, R-La., told FoxNews.com. “Instead you have the secretary of state saying the U.S. will give another $100 billion of money we don’t have to countries who don’t like us.”

    But a senior administration official said Thursday that Obama will not announce more financial commitments and believes his administration has demonstrated that the U.S. is willing to take all steps possible to fight global warming.

    Still, the U.S. is under renewed pressure to improve its pledge of greenhouse-gas emission cutbacks — by about 17 percent by 2020, compared with 2005 figures. That’s only a 3 percent to 4 percent reduction from 1990, the benchmark year for the Kyoto countries and the basis for the European Union’s pledge to cut emissions by at least 20 percent by 2020.

    “I have to be honest, an offer by the United States to cut only 4 percent from 1990 levels is not ambitious enough,” German Chancellor Angela Merkel told lawmakers in Berlin before arriving in Copenhagen.

    But Obama can’t make a stronger offer without the support of the Senate, where climate change legislation is stuck and won’t be taken up again until next year.

    “What we are seeing is the can being kicked down the road to the next meeting of parties” in Mexico, said Pat Michaels, a senior fellow in environmental studies at the libertarian Cato Institute. Michaels said he didn’t believe Obama’s appearance at the summit would accomplish much, making it “an injudicious use of fossil fuel.”

    The biggest obstacle for the U.S. has been China as a diplomatic duel between Washington and Beijing has marked the two weeks of climate talks.

    Gibbs expressed hope that China would not abandon the remaining talks, undermining prospects for any credible global warming deal.

    “We hope the Chinese will state and be part of finding a solution,” Gibbs said. “If the Chinese are unwilling to be able to prove to the world that they can live up to an agreement that they make, then I think it calls into question whether or not you truly have an agreement. The elements of getting an agreement are there if countries like China will make some common sense agreements about transparency.”

    Gibbs laid to rest speculation that Obama would cancel his trip as the summit ground to a halt Wednesday over a dispute between rich and poor nations. There is “no change in our plans,” he said.

    Global warming skeptics suggested Obama had no choice but to attend, because he has staked the first year of his presidency on the issue.

    “They’re going to try and make the best of a lose-lose proposition,” said Pat Creighton, a spokesman for the conservative Institute for Energy Research.

    Scalise, a member of the Energy committee, was at a loss to explain why Obama would stick to his planned trip amid so much uncertainty and lower expectations.

    “I think he’s still trying to find some way to justify his Nobel Peace Prize, but it’s coming at the expense of the U.S. economy and is based on corrupt science,” he said, referring to the “Climate-gate scandal” in which stolen e-mails at a prominent university showed researchers manipulated data to make their case for global warming.

    Well guys and gals I have been in the hospital sinced last friday night. I feel off a latter putting christmas lights up and broke my hip. I just got out of the hospital this morning. So damn glad to be out of the hospital. I ended up with a full hip replacement. The doctor said I had to be off work for 2 weeks. I hope I don’t lose my job over this. It’s getting better by the day. It should be 100 percent after 60 days. Sure missed you all.

    SH, I am a tough old SOB that has a high tolerence to pain and an incredible will to get better faster. Yes I am lucky. It could have been worse .I fell 10 feet onto hard pavement. I controlled my fall the best I could. Believe it or not most people heal faster with a total hip replacement and the doctor told me I was going to need one anyway in about 10 years or more.

    DOE, Utah reach deal on waste
    Salt Lake City – The Department of Energy said Thursday that it has struck a deal with Utah Gov. Gary Herbert that would prohibit radioactive waste from South Carolina from being permanently buried in Utah until stricter state guidelines are put in place.

    DOE spokeswoman Jen Stutsman said the agreement was reached Thursday, two days after Herbert called on the department to stop a train loaded with depleted uranium from leaving the Savannah River Site near Aiken, S.C.

    The material is waste from the development of nuclear weapons in the Cold War era.

    State regulators say they need more time to determine whether depleted uranium can safely be disposed of at EnergySolutions Inc.’s site about 70 miles west of Salt Lake City. Depleted uranium is different from other waste disposed there because it becomes more radioactive over time, for up to 1 million years.

    The first train, carrying 5,408 55-gallon drums of waste, won’t be stopped or turned around, Stutsman said. But the DOE agreed to place its waste in temporary storage once it arrives in Utah, rather than permanently disposing of it.

    The waste is expected to arrive in Utah in the next two weeks.

    and dang if a big dog didn’t bust through a window on my back porch last night. The window had a hole in it that was covered with plastic that had already been breeched by neighbor cats. But I heard glass shattering and then found this great big dog on my porch. Poor thing got scared and before I could let him out the door, he squeezed through the window again. It was just one pane of many on this enclosed porch. I think he almost got stuck because it’s not all that big. I am so glad he didn’t cuz I am scared of strange dogs altho this guy didn’t seem vicious.

    “The Nobel Prize of War just finished saying here that he is here to act. Well, show it sir. Don’t leave by the back door. Eh? Do everything you have to do to adhere to the Kyoto Protocol. We are going to support Kyoto. We’re going to tell the world in a transparent way, all of this. And I think all of us agree that carbon emission reduction for 2050 should be less than 80 or 90 %. The majority agrees on this.”

    The Venezuelan president used the international forum Wednesday to slime developed nations for creating an “imperial dictatorship” that rules the world, urging his audience to “fight against capitalism,” the “silent and terrible ghost” that was haunting the elegant conference chambers in the Danish capital.

    “I promise I won’t talk more than others have talked this afternoon,” he said at the start of a rambling, 25-minute diatribe that outshot other speakers by a full 20 minutes. In the wide-ranging speech, he called capitalism the “road to hell” responsible for poverty, murder, AIDS — and even unfair climate agreements, the Toronto Star reported.

    Calling on spiritual leaders as varied as Jesus, Muhammad and Karl Marx, Chavez bellowed that climate discussions were going on behind closed doors and draft agreements remained “top secret.”

    “The text presented is not democratic or inclusive,” said Chavez, who has made it a practice in his native Venezuela to close opposition newspapers, radio stations and TV networks, and jails dissident politicians on spurious charges.

    “It’s not democratic, it’s not inclusive. Well, ladies and gentlemen, isn’t that the reality of the world? Are we really in a democratic world?”

    Chavez regularly regales a captive audience of millions of Venezuelans on his weekly “Alo Presidente” talk shows, the marathon TV and radio sessions that give him space to rail against the bourgeoisie, excoriate the U.S. and even sing a ballad when the mood strikes.

    By comparison, his Copenhagen screed was brief, but was certainly gobbled up by many delegates in attendance who let out a nervous laugh as he attacked President Obama.

    “I think Obama isn’t here yet. He got the Nobel Peace Prize almost the same day as he sent 30,000 soldiers off to kill innocent people in Afghanistan,” Chavez said.

    But the commandante did manage to address climate change itself, warning of the dangers posed by the failure to rein in carbon emissions and give aid to the Third World.

    “If we don’t do this, then the great creation of our planet — humans — will disappear,” he said. “It doesn’t need us, but we can’t exist without it. We’re destroying it,” he said — destroying mother earth.”

    It could be a tough act to follow for Obama, who arrives in Copenhagen Friday with a large American delegation in tow.

    Obama and the estimated 120 world leaders who are converging on the city hope to hammer out a framework deal in the closing hours of the conference — a stormy two weeks marked to the end by flare-ups between the developed world and developing nations.

    VF, well I keep my catfood in a bucket out there. That’s the only thing. I have gotten stray cats breaking in and getting into it so I keep something heavy on the lid. But the dog was scared after he crashed through the window and just wanted back out I think. I will have to go out and check for any blood in the snow. I hope that critter didn’t get cut bad.
