    CNSNews.com) – Homeland Security Secretary Janet Napolitano announced Tuesday that she is pursuing plans to remove some captured illegal aliens from “prison-like or jail-like circumstances” and put them in converted hotels and nursing homes.

    “To better manage detention operations, ICE will develop a risk assessment and custody classification, which will enable detainees to be placed in an appropriate facility,” DHS said in a statement. “ICE will pursue detention strategies based on assessed risk and reduce costs by exploring the use of converted hotels, nursing homes and other residential facilities.”

    Napolitano explained her department’s thinking at a press conference at Immigration and Customs Enforcement headquarters in Washington, D.C.

    “Our detention system has some who have committed crimes, others whose crimes under federal law is a misdemeanor, others who have as I said before not committed a crime at all,” Napolitano said.

    DHS detained about 378,000 aliens last year, who at any given time “occupy 32,000 to 34,000 beds across the country,” Napolitano said at her press conference. She said DHS would likely end its contractual relationships with at least some detention facilities currently holding illegal immigrants.

    The department, Napolitano said, intended “to review all contracts for detention facilities to identify not only opportunities for improvement but also for renegotiation and indeed termination where warranted.”

    Napolitano noted that DHS will develop detention strategies based on assessed risk that will reduce costs and put illegal aliens “near immigration service providers.” These strategies will include pursuing the use of non-prison-like housing.

    “As was said, this is a system that encompasses many different types of detainees, not all of whom need to be held in prison-like circumstances or jail-like circumstances, which not only may be unnecessary but more expensive than necessary,” said Napolitano.

    “We will begin to house nonviolent non-criminals, such as newly arrived asylum seekers, at facilities commensurate with the risks that they present,” said Napolitano. “And we will also begin efforts to house these populations near immigration service providers and pursue different options like converted hotels or residential facilities for their detentions.”

    Napolitano said DHS and ICE would provide a plan to Congress on that she called ‘alternatives to detention.’

    “We will develop an assessment tool to identify those aliens suitable for alternatives to detention,” she said. “And we will submit a plan to Congress this fall to implement such a nationwide system.”

    When CNSNews.com asked to clarify Wednesday what DHS means by “Alternatives to Detention” (ATD) that it is considering using in dealing with captured illegal aliens who are awaiting deportation or potential deportation, Gillian Brigham, a spokeswoman with ICE, said “a range of alternatives” were being considered, including releasing and supervising, rather than detaining, some illegal aliens who have been arrested.

    “‘Alternatives to Detention’ is kind of a range of things, and that includes stuff like electronic monitoring or intensive supervision, where people come and report into an office three times a week to a certain deportation officer there. Or have some sort of electronic monitoring,” Brigham said.

    As many as 15,000 illegal aliens are already in ATD program, Brigham said.

    Brigham said it would be up to ICE officers and case workers to decide whether a non-criminal illegal alien is placed in the “less restrictive” detention in a converted hotel, nursing home or other residential facilities, released and monitored electronically, or required to report to an ICE office a specific number of times per week.

    CNSNews.com asked Napolitano if the “alternatives to detention” program would be modeled on the catch-and-release system previously used in federal immigration enforcement. This involved releasing captured illegal aliens into the general population pending a court date. Many did not show up for the court proceeding.

    The catch-and-release policy was ended during the Bush administration.

    “No, you’re right,” said Napolitano. “And catch-and-release was problematic, and I can say that. I was governor of Arizona, and before that I was the attorney general of Arizona. So, we see what worked and what didn’t work.

    “And so one of—two of the issues that we need to make sure are covered as we look at alternatives to detention are, A, that those who are given ATD are not going to use that to escape, basically, or get into the general population in a way that we can’t quickly find them and get them back,” Napolitano added.

    She said that another problem with alternatives to detention in the past is that it often actually prolonged adjudication of illegal aliens’ immigration case.

    “A second is as follows,” said Napolitano. “One of the things that was happening over time because we were detaining so many, and will continue that as we do immigration enforcement, was that if somebody was given an alternative to detention, then they were kind of put at the back of the line in regards to actually having their status adjudicated.

    “And so they were actually kind of in detention longer than they would have been if they’d simply been held and gone to an immigration court, had their status adjudicated and the removal completed,” she said.

    Janice Kephart, national security policy director at the Center for Immigration Studies, believes that “alternatives to detention” is just another name for the failed “catch and release” model.

    “‘Alternatives to Detention’ is just another way to say ‘Catch and Release,’ which was the thorn in the side of the prior administration until they stopped it and put rule of law in place,” said Kephart.

    “Although managing detention facilities and their populations well is a good goal, simply doing it by reducing the illegal population and dispersing them back into American communities does not help enforce immigration law or make our communities more secure,” Kephart said.

    Kephart pointed out that Mir Aimal Kansi, who murdered two CIA employees outside the agency’s Langley, Va., headquarters; Ramzi Yousef, who masterminded the 1993 attack on the World Trade Center; and Sheik Omar Abdel Rahman, who inspired the 1993 attack on the World Trade Center, had all been asylum applicants who were left free in the United States.

    Hoyer Won’t Rule Out Voting on Senate Health Bill Without Changes and Sending it Directly to President
    Wednesday, October 07, 2009

    (CNSNews.com) – House Majority Leader Steny Hoyer (D-Md.) won’t rule out having the House vote on the Senate health-care bill without making any changes in it, which would allow the bill to go directly to President Barack Obama without having to pass through a House-Senate conference committee and another round of votes in the House and Senate–and a longer period of public scrutiny of what the text of the proposed law actually says.

    “I won’t rule it out or in because I don’t know what the package is,” Hoyer told CNSNews.com on Tuesday.

    “However, content will be critical in what action the House takes,” he added a moment later.

    Under the proposal, Senate Majority Leader Harry Reid (D-Nev.) would offer the Senate’s version of health reform as an amendment to a House-passed bill, H.R. 1586, which levies a 90-percent tax on bonuses received this year by employees of financial institutions that took at least $5 billion in government bailout money. Reid’s amendment would strip out the substance of H.R. 1586 as passed by the House and replace it with the entirety of the Senate health care bill.

    As a senior aide to Reid explained to CNSNews.com, this would be done because the Constitution only allows the House to initiate revenue bills, and since the Senate health care bill contains revenue provisions it technically cannot be initiated in the Senate. By being amended into the “shell” of H.R. 1586, which is a House-initiated revenue bill, the Senate health care bill would technically become a House bill.

    If Reid can muster enough votes (60) to overcome a filibuster of this maneuver and filibusters of any amendments subsequently made to the bill, Senate Democrats could pass their health care bill and send it back to the House, where it nominally originated. See related story here.

    Normally, when a bill is passed in two different versions, negotiators from both the House and Senate meet in a conference committee to amend the bill and arrive at a final version, which is then passed by both chambers and sent to the president.

    However, if the House were to pass H.R. 1586 when it comes back from the Senate without adding any amendments, the bill would not need to go to a conference committee and could be sent straight to the president for his signature.

    Such a course of events could greatly shorten the time the public has to study and debate the final text of the health care bill–which will be crafted by Senate Majority Leader Reid in consultation with whomever he chooses to consult. News reports say Reid’s office is now working closely with the White House on the final language of the bill.

    On Tuesday, CNSNews.com asked Hoyer: “The Senate is considering using H.R. 1586–a bill that already passed the House, some bonuses received by TARP recipients–as a shell to hold their health care bill. In other words, they would amend 1586 to include their entire language of their health bill and then send it to the House.

    “If that happens, will you rule out holding a direct vote on the Senate health care package in that form, which would send it to the president without amending it or sending it to conference?”

    Hoyer said: “Well, I won’t rule it out or in because I don’t know what that package is, nor does the Senate at this point [because] they still have the necessity to harmonize the HELP [Health, Education, Labor, and Pensions Committee] bill and the Finance [Committee] bill. So it would be premature for me to answer that question because I don’t know exactly what form it’s going to be in.

    “Having said that, obviously the reason they’re doing that, as you well understand, is because there are component parts of their bill that would need to be generated in the House, under the Constitution would need to be initiated by the House. That’s a House bill and it’s a useful vehicle for them to use, so that is why it would be premature for me to say that I support moving that as is at this point in time.”

    CNSNews.com: “So it depends on the content of the bill, not the way they get it to the House?”

    Hoyer: “Yep. Constitutionally, there are some reasons why it has to be a House bill. However, content will be critical in what action the House takes.”

    Tellit – people ignore that which either frightens them or overwhelms them. When I fly out to see my brother in Iowa, I go through Detroit. It has the largest Muslim population (Arabic) in the US. Signs in the airport are Arabic and English. I asked a woman in a native dress all about it and she was so talking down to me. She said “you are unaware of our contributions to the world.” I finally looked her straight in the eyes and said “We are not all culturally and historically dumb here. We acknowledge and KNOW about your culture and contributions.”

    Baha Uddin, who lives near the church, had complained he was unable to use his garden at weekends and his one-year-old daughter was regularly disturbed by the noise from services.

    He said: ‘It’s been a nightmare. I’ve not been able to use my garden or living room on a Sunday because of the church services. The amplified music, drums and the loud sermons made having a conversation impossible. The noise made me depressed.’

    But other neighbours say the noise is not a problem. The church lodged an appeal, and appeared at Waltham Forest magistrates’ court on Tuesday.

    In court Mrs Odetoyinbo, 55, claimed a council officer had asked her ‘to keep the noise down so as not to offend the Muslim community’.

    But magistrates rejected the appeal, and ordered the church to pay £2,250 costs.

    House Speaker Nancy Pelosi was taking issue with a National Republican Congressional Committee press release that accused her of backing down to liberals in her caucus who oppose Gen. Stanley A. McChrystal’s recommendation for an escalation of troops in Afghanistan

    House Speaker Nancy Pelosi cast House Republicans as behind the times, or worse, after they suggested that the top American commander in Afghanistan should “put her in her place.”

    “They really don’t understand how inappropriate that is,” the California Democrat said of the phrasing, contained in a news release this week from the National Republican Congressional Committee.

    “I’m in my place. I’m the Speaker of the House, the first woman Speaker of the House. And I’m in my place because the House of Representatives voted me there,” she added. “But that language is something I haven’t even heard in decades.”

    She was taking issue with a National Republican Congressional Committee press release that accused her of backing down to liberals in her caucus who oppose Gen. Stanley A. McChrystal’s recommendation for an escalation of troops in Afghanistan.

    Pelosi had been quoted as saying that voting for an escalation was a difficult choice for members of her caucus whose constituents oppose such action.

    “If Nancy Pelosi’s failed economic policies are any indicator of the effect she may have on Afghanistan, taxpayers can only hope McChrystal is able to put her in her place,” the release said.

    McChrystal’s recommended approach calls for as many as 40,000 additional troops in Afghanistan for a counterinsurgency campaign to defeat the Taliban, build up the central government and deny al-Qaida a haven.

    Many Democrats, aware of rising anti-war sentiment in their ranks and the war protests that have dotted Washington this week, oppose such a surge.

    According to a new Associated Press-GfK poll, public support for the war has dropped to 40 percent from 44 percent in July.

    During the 45-minute discussion, on the Islam Channel programme Muslimah Dilemma earlier this week, the two members of the group made repeated attacks on secular “man-made law” and the West’s “lethal cocktail of liberty and capitalism”.

    They called for Sharia Law to be “the source of legislation” and said that women should not be “permitted to hold a position of leadership in government”.

    Miss Mogahed made no challenge to these demands and said that “promiscuity” and the “breakdown of traditional values” were what Muslims admired least about the West.

    Gender justice? Under shari’a, a woman’s testimony in court only counts for half of that of a man. If a woman is raped, she needs four male witnesses to prove her case. If she makes the accusation and doesn’t find four witnesses, the victim gets charged with fornication or adultery and faces death.

    Under what definition of “gender justice” does that fall? The laws of shari’a deliberately make women chattel to their husbands, fathers, or brothers. Its application keeps women in some countries from being allowed to venture out in public on their own, without an adult male family member to accompany them.

    Instead of defending the rights of women and secular application of law, which is the basis of our law, the advisor of the President of the United States fails to answer a demand for the imposition of an extreme religious code on free people. Mogahed also never rebutted the notion that women should not hold public office, which directly challenged her own status, but also insulted many women in American public life in both parties. I wonder what Nancy Pelosi and Hillary Clinton think about that performance.

    If that’s the kind of outreach that wins Nobel Peace prizes, then the Norwegians must value the oppression of women in Muslim countries and the Western nations that appease that oppression.

    Can we actually impeach Barack Hussein Obama? Should we impeach Barack Hussein Obama?

    To borrow a phrase from the “anointed-one,” … “yes we can.”

    But before going on, we really need to address the often misunderstood subject of what exactly constitutes an impeachable offense, in order to illustrate that Barack Hussein Obama’s actions are grave enough to warrant impeachment.

    Former President Gerald Ford, while serving in the House of Representatives, said an impeachable offense was, “whatever a majority of the House of Representatives considers it to be at a given moment in history.”

    Article I, Section 4 of the Constitution reads: “The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.”

    The key phrase here is “high crimes and misdemeanors,” a concept in English Common Law that was well-known to our Founding Fathers but is grossly misunderstood in this day and age.

    “High crimes and misdemeanors” essentially means bad behavior.

    Here’s a passage from C-Span.org which succinctly and beautifully summarizes the historical significance surrounding the inclusion of the term “high crimes and misdemeanors” in the Constitution:

    “‘High crimes and misdemeanors’ entered the text of the Constitution due to George Mason and James Madison. Mason had argued that the reasons given for impeachment – treason and bribery – were not enough. He worried that other ‘great and dangerous offenses’ might not be covered… so Mason then proposed ‘high crimes and misdemeanors,’ a phrase well-known in English common law. In 18th century language, a ‘misdemeanor’ meant ‘mis-demeanor,’ or bad behavior.”

    In other words, “high crimes and misdemeanors” does not refer to a criminal act (as some would lead you to believe… at least our Founding Fathers did not believe so) and the Founders fully intended to allow for the removal of the President for actions which were… well… simply put… egregious… grossly incompetence… grossly negligence… outright distasteful… or, in the case of Barack Hussein Obama, actions which clearly show “malevolence toward this country, which is unabated.”

    And make no mistake, for those who mistakenly hold the illusion that impeaching Barack Hussein Obama would be a simple matter of “playing politics,” the Founders fully intended that the impeachment of a sitting President be a political act.

    As C-Span.org notes:

    “The Congress decides the definition [of impeachable offenses]: by majority vote in the House for impeachment, and by 2/3 vote in the Senate for conviction. The Framers of the Constitution deliberately put impeachment into the hands of the legislative branch rather than the judicial branch, thus transforming it from strictly a matter of legal definition to a matter of political judgment. Then Representative Gerald Ford put it into practical perspective in 1970, when he said an impeachable offense is ‘whatever a majority of the House of Representatives considers it to be at a given moment in history.'”

    The Obama Administration exemplifies maladministration. It qualifies as the poster-child for bad behavior.

    Obama and those around him are ravaging this great country and adding a sorry chapter to a noble history.

    Impeachment, as written in the Constitution, was tailor-made for Barack Hussein Obama and our Founders placed it in our Constitution for such a time as this.

    It could be easily argued that we have a duty to impeach Barack Hussein Obama.

    Of course, our elected officials won’t have the back-bone to go it alone. That’s where you come in.

    Help us spread the word far-and-wide and our elected officials will come to know that the impeachment of Barack Hussein Obama is the will of the American people and that if they ignore the will of the people. they do so at their own political peril.

    The question is not whether we should impeach Barack Hussein Obama. Rather, the question is, can we impeach Barack Hussein Obama before it is too late?

    I really do not understand why certain people go to the Western world and want to change things which is part of that country’s right to a free and democratic society. I am British and married to an Iranian. I got married in Iran and lived there for most of my life until we finally managed to leave Iran, the country we love and respect very much, in 1985 and come to England. The reason: it was very suffocating and repressive and depressive. We were not practicing Muslim and if we were, we would have stayed put or gone to another Islamic country eg Saudi Arabia, the birth place of Islam. I believe Islam is not a religion anymore for some people but sadly has become a business. There are people out there including miss Dalia Moghahed who are making money by writing books, giving seminars and just preaching about what they think is right and yes she wears her scarf so she can say whatever she wants and nobody, at least in the political correctness of the West, and say but I am a good Moslem I wear my Hijab(whatever that means!!), she would be subject to 50 lashes if she were in her country of origin, Egypt. Honestly if you see the appreance of some of these young Moslem girls! in UK: With their fancy head coverings and 3 inch makeup and red lipstick and Cleopatra eyemakeup, if they wer in Iran they would have been arrested and somehow disfigured!!
    The fact of the matter is, and it is really quite simple: if you don’t like the West then don’t come and go back to a country that you feel make you more comfortable. We need to stop these people who are using religion as a mean of making money and building hatered amongst others. If miss Moghahed is really concered then she needs to go and use her education and educate people out of ignorance so men and women can live side by side with mutual respect and harmony, she could also arrange an anti fudamantalist or Islamist demonstration to prove her point, IF SHE DARES.
