    The Rasmussen Reports daily Presidential Tracking Poll for Thursday shows that 29% of the nation’s voters Strongly Approve of the way that Barack Obama is performing his role as President. Thirty-seven percent (37%) Strongly Disapprove giving Obama a Presidential Approval Index rating of -8 (see trends).

    Pennsylvania Senator Arlen Specter is feeling the heat of the health care debate. He now trails Republican Pat Toomey by double digits in an early look at the potential 2010 race. Two months ago, Specter led by double digits. Most Pennsylvania voters oppose the Congressional health care reform effort. Also, Specter’s lead is shrinking in his Democratic Primary match-up with Congressman Joe Sestak.

    The Presidential Approval Index is calculated by subtracting the number who Strongly Disapprove from the number who Strongly Approve. It is updated daily at 9:30 a.m. Eastern (sign up for free daily e-mail update). Updates also available on Twitter.

    Overall, 47% of voters say they at least somewhat approve of the President’s performance. That’s the lowest level of total approval yet recorded. The President’s ratings first fell below 50% just a few weeks ago on July 25. Fifty-two percent (52%) now disapprove.

    Seventy-seven percent (77%) of Republicans disapprove along with 65% of those not affiliated with either party. Seventy-eight percent (78%) of Democrats offer their approval. Most women (51%) offer their approval while most men (56%) disapprove.     Later today, Rasmussen Reports will release new data on which party voters trust when it comes to health care. Premium Members can get an advance look at the data.

    Nationally, support for the health care reform plan proposed by President Obama and congressional Democrats has fallen to a new low. Just 42% favor the plan while 53% are opposed. Other data shows that 51% fear the federal government more than private insurance companies. Forty-one percent (41%) fear the insurance companies more. Overall, 32% favor a single-payer health care system for the U.S. while 57% are opposed.

    Sixty-six percent (66%) oppose Mexican trucks on U.S. highways while just 19% favor lifting that ban. Most oppose Canada’s request to lift the Buy American provision for projects funded by the stimulus package.

    In the Virginia Governor’s race, Republican Bob McDonnell has opened a nine-point advantage over Democrat R. Creigh Deeds. In New Jersey’s race for Governor, incumbent Democratic Governor Jon Corzine trails by double digits. Republicans maintains a modest lead over Democrats on the Generic Congressional Ballot.

    It is important to remember that the Rasmussen Reports job approval ratings are based upon a sample of likely voters. Some other firms base their approval ratings on samples of all adults. President Obama’s numbers are always several points higher in a poll of adults rather than likely voters. That’s because some of the President’s most enthusiastic supporters, such as young adults, are less likely to turn out to vote. Other factors are also important to consider when comparing Job Approval ratings from different polling firms.

    A Fordham University professor has rated the national pollsters on their record in Election 2008. We also have provided a summary of our results for your review.

    Daily tracking results are collected via telephone surveys of 500 likely voters per night and reported on a three-day rolling average basis. The margin of sampling error—for the full sample of 1,500 Likely Voters–is +/- 3 percentage points with a 95% level of confidence. Results are also compiled on a full-week basis and crosstabs for full-week results are available for Premium Members.

    Like all polling firms, Rasmussen Reports weights its data to reflect the population at large (see methodology). Among other targets, Rasmussen Reports weights data by political party affiliation using a dynamic weighting process. While partisan affiliation is generally quite stable over time, there are a fair number of people who waver between allegiance to a particular party or independent status. Over the past four years, the number of Democrats in the country has increased while the number of Republicans has decreased.

    Our baseline targets are established based upon separate survey interviews with a sample of adults nationwide completed during the preceding three months (a total of 45,000 interviews) and targets are updated monthly. Currently, the baseline targets for the adult population are 38.4% Democrats, 32.7% Republicans, and 28.9% unaffiliated. Likely voter samples typically show a slightly smaller advantage for the Democrats.

    Foreclosures rise 7 percent in July from June

    WASHINGTON – The number of U.S. households on the verge of losing their homes rose 7 percent from June to July, as the escalating foreclosure crisis continued to outpace government efforts to limit the damage.

    Foreclosure filings were up 32 percent from the same month last year, RealtyTrac Inc. said Thursday. More than 360,000 households, or one in every 355 homes, received a foreclosure-related notice, such as a notice of default or trustee’s sale. That’s the highest monthly level since the foreclosure-listing firm began publishing the data more than four years ago.

    Banks repossessed more than 87,000 homes in July, up from about 79,000 homes a month earlier.

    Nevada had the nation’s highest foreclosure rate for the 31st-straight month, followed by California, Arizona, Florida and Utah. Rounding out the top 10 were Idaho, Georgia, Illinois, Colorado and Oregon. Among cities, Las Vegas had the highest rate, followed by the California cities of Stockton and Modesto.

    While there have been numerous recent signs that the ailing U.S. housing market is finally stabilizing after three years of plunging prices, foreclosures remain a big concern. Foreclosures are typically sold at a deep discount, hurting neighbors’ home values.

    The mortgage industry has been slow to adapt to the surge in foreclosures. Many lenders have needed government prodding to get up to speed with the Obama administration’s plan to stem foreclosures.

    The Treasury Department said last week that banks have extended only 400,000 offers to 2.7 million eligible borrowers who are more than two months behind on their payments. More than 235,000, or 9 percent, those borrowers have enrolled in three-month trials in which their monthly payments are reduced.

    “The volume of loans that are in distress simply overwhelms” those efforts, said Rick Sharga, RealtyTrac’s senior vice president for marketing.

    What is Constitutional?

    Our founding fathers wanted limited government. The plan for government would make it difficult for any person or group to have unlimited power, and make it difficult to get anything done quickly so thought could be given to law. This plan for government was called the Constitution. The Framers of the Constitution listed the powers that they were giving to the federal government and was allowed to do only those “enumerated powers.”

    Do you remember that from Public School? THE CONSTITUTION WAS WRITTEN TO LIMIT GOVERNMENT. It is a Commie Lib myth that it is a “living breathing document”. Hence, only 27 Amendments.

    American History and the Constitution are either 1) not taught, b) not taught correctly, i.e. it’s ancient history and an ancient document, 3) or taught in such a bland and mundane way that no one will remember it. And lets not forget about the indoctrination that comes with the public school system.

    In The Carnegie Reporter, 2005 Larmar Alexander, (R) Tennessee wrote, “…the last several decades have witnessed a sharp decline in the teaching of American history and civics in our public schools… our public schools are not teaching the history and values that are the American ideology. Instead, students hear a watered-down version of our past, and civics is often dropped from the curriculum entirely.”

    On August 9, 2006 Katheryn Kilbert wrote in the New York Times, “Americans know more about “The Simpsons” than they do about the First Amendment… Too few Americans, particularly young people, understand our Constitution and the civil rights and liberties that Americans take for granted… Unfortunately, today fewer and fewer college students grapple with the history of the Constitution, its language or meaning. At a time when constitutional issues, from privacy to presidential power, gun control to Guantanamo Bay, confront this nation daily, understanding the Constitution should be the hallmark of citizenship, not its forgotten tradition.”

    In 1794, Congress appropriated $15,000 for relief of French refugees who fled from insurrection in San Domingo to Baltimore and Philadelphia, James Madison stood on the floor of the House to object, “I cannot undertake to lay my finger on that article of the Constitution which granted a right to Congress of expending, on objects of benevolence, the money of their constituents.”

    Constitutional limits on federal power are explained by James Madison in Federalist Paper No. 45: “The powers delegated by the proposed Constitution to the federal government are few and defined… be exercised principally on external objects, as war, peace, negotiation, and foreign commerce.”

    This is directly out of Article 1, Section 8 of the Constitution. Article 1, Section 8 explains the LIMITED role of Congress. We’ve let Congress and the Presidents get out of hand. We’ve failed because we don’t understand the Constitution.

    Commie libs think the meaning of “general welfare” means that Congress can do just about anything it wants to. Again, this is because of our ignorance of history and the Constitution.

    In a letter James Madison, wrote to Edmund Pendleton “If Congress can do whatever in their discretion can be done by money, and will promote the ‘general welfare’, the government is no longer a limited one, possessing enumerated powers, but an indefinite one …With respect to the two words ‘general welfare’, I have always regarded them as qualified by the detail of powers connected with them. To take them in a literal and unlimited sense would be a metamorphosis of the Constitution into a character which there is a host of proofs was not contemplated by its creators.”

    Thomas Jefferson wrote in a letter to Pennsylvania Representative Albert Gallatin, “Congress has not unlimited powers to provide for the general welfare, but only those specifically enumerated… Whensoever the General Federal Government assumes undelegated powers, its acts are unauthoritative, void, and of no force.”

    In a speech to the Virginia Ratifying Convention, James Madison said, “The powers of the federal government are enumerated; it can only operate in certain cases; it has legislative powers on defined and limited objects, beyond which it cannot extend its jurisdiction”.

    Does it sound like our founding fathers wanted an “all encompassing” government? They rebelled against a tyrannical king who was the “all encompassing” government. A government with too much power – the power to take away rights and freedom. A government with power to take away our God-given rights, had to be stopped. And they did it.

    They specifically wrote the Constitution to preserve a “separation of powers” and to give specific powers to our federal government. Our Constitution reserves all powers not specifically granted to the federal government are to go respectively to the states and to the people. IT’S IN THE CONSTITUTION! It’s called the 10th Amendment.

    “I consider the foundation of the Constitution as laid on this ground that ‘all powers not delegated to the United States, by the Constitution, nor prohibited by it to the states, are reserved to the states or to the people.’ To take a single step beyond the boundaries thus specially drawn around the powers of Congress, is to take possession of a boundless field of power not longer susceptible of any definition.” It seems Thomas Jefferson agrees with me in his “Opinion on the Constitutionality of a National Bank”, February 15, 1791

    Limited government requires individual responsibility for one’s actions. We are to be responsible for ourselves without dependence upon the government for “hand-outs” or “welfare”. Government should not be, nor should we expect, involvement in “social engineering” nor in the re-distribution of wealth.

    Each new law passed is taking of freedom and responsibility from individuals and transferring it to the government and we need to recognize this. Instead of “limited government” we have been subsidizing “unlimited government”.

    Benjamin Franklin articulated, “Those who would give up essential Liberty to purchase a little temporary Safety, deserve neither Liberty nor Safety”.

    And Thomas Paine wrote in Rights of Man, “We still find the greedy hand of government thrusting itself into every corner and crevice of industry, and grasping at the spoil of the multitude. Invention is continually exercised to furnish new pretenses for revenue and taxation. It watches prosperity as its prey and permits none to escape without a tribute”.

    I hear Obummer’s a Constitutional lawyer. I’m sure he is, but he defies the Constitution. He relies on the fact that we don’t know the Constitution. He and other Presidents since Woodrow Wilson have expanded government. The stimulus packages, cap-and-trade, and healthcare will increase governments power giving us less freedom. The government is utilizing or creating these crisis’s to scare us into giving them this power. We have to hold out, because when we don’t give in, the lies will unravel.

    Although the cash for clunkers program has been refueled with a $2 billion cash injection by Congress, some auto dealers’ bank accounts are still running on fumes, waiting to get reimbursed by the government.

    Dealers across the country are reporting that reimbursement issues continue to stall the wildly popular incentives program. They have submitted requests for rebates on 338,659 vehicles sold, at a cost of about $1.4 billion to the government, according to sales data summarized by Transportation Department officials.

    David Wilson, a Toyota dealer in Orange County, Calif., told Automotive News that he has been paid for only three of 92 claims he submitted before Aug. 2, leaving him on the hook for about $374,000. In total, he has 450 unpaid claims filed for $1.9 million.

    “I’m worried the government will run out of money before we get paid,” he told the publication.

    Brad Wood, a dealer in Salisbury, N.C., has 12 unpaid claims for $47,000 pending since Aug. 1.

    “I’ve never experienced anxiety like this in business before,” he told the auto publication. “If I don’t get paid, I will have been working almost free for several months.”

    The Department of Transportation has said it is reviewing every clunkers application with a staff of 225 people.

    The program nearly ran out of money only a week after it began last month. So Congress added $2 billion to the program this month, tripling the $1 billion fund that had led to big crowds at once deserted auto showrooms and extending it into Labor Day

    Under the program, passenger car owners are eligible for a voucher worth between $3,500 and $4,500 if they trade in their gas guzzlers for new, fuel-efficient vehicles.

    Several dealers told Automotive News that their applications were rejected because of procedural issues that they couldn’t clear because they were unable to reach Transportation Department employees by phone or e-mail.

    “While problems with application submissions for the clunkers program have been significantly reduced, getting approval for dealer reimbursement requests is still facing significant hurdles,” John Lyboldt, vice president for dealer operations for the National Automobile Dealers Association, said in a written statement Thursday.

    He said NADA is currently working with the National Highway Traffic Safety Administration to streamline the process and help dealers get paid in a timely manner.

    He said several recent entries on the CARS.gov Web site, including issues relating to transaction contingency agreements and the timing of vehicle delivery, have created confusion.

    Lyboldt said the burdensome amount of documentation required for submission is causing many applications to be rejected.

    “Resubmitted applications are making a bad situation worse by adding to the backlog,” Lyboldt said. “It is critical that before submitting the paperwork to NHTSA that every dealer double and triple check that every ‘i’ is dotted and every ‘t’ is crossed.”

    Now “Color of Change” has bullied at least five of Beck’s big advertisers — SC Johnson, Progressive Insurance, Geico, Procter & Gamble and Nexus Lexis — to pull their ads from Beck’s national cable program. Jones, the founder of “Color of Change,” was named Special Advisor for Green Jobs at the White House Council on Environmental Quality — a key administrative post — this past March.

    Putting tax-payer dollars to dubious use, the not-for-profit organization has hired well-heeled Hollywood publicist Ken Sunshine to further instigate the boycott.

    WASHINGTON – Key senators are excluding a provision on end-of-life care from health overhaul legislation after language in a House bill caused a furor.

    Senator Chuck Grassley of Iowa, top Republican on the Senate Finance Committee, said in a statement Thursday that the provision had been dropped from consideration because it could be misinterpreted or implemented incorrectly.

    A health care bill passed by three House committees allows Medicare to reimburse doctors for voluntary counseling sessions about end-of-life decisions. But critics have claimed the provision could lead to death panels and euthanasia for seniors.

    The Senate Finance Committee is still working to complete a bill.

    Good morning blogging best friends. I have just been reading John King’s long winded but well intended piece at CNN about conditions on the Lakota Indian Reservation (Nation) at this moment. Federal funds reached them from our current indebtedness compliments of the Chinese. However, overall, current conditions are generational both in dealing with the Feds and in dealing with each other. Here is a critical portion of the article:

    To be clear, Chairman Brings Plenty and Bryce In the Woods say not all of the tribe’s problems rest with the federal government.

    Both mentioned obstacles and disagreements born of factional tribal politics and rivalries, which were in full evidence during just a few minutes of the Tribal Council’s debate.

    In The Woods is also a strong advocate for land reforms he says would get the tribe a better deal for grazing rights on its property.

    Still, they would welcome more economic development help, from the state and from Washington, but say their voices don’t always get heard, even in the best of times.

    “When it comes down to a vote, a lot of the urban representatives, I don’t think they really know the plight on the reservation,” Bryce In the Woods said. “I think there is a stereotype out there that all tribes have casinos and that’s not true.”

    Herbert Hale shrugs when asked if Washington has a responsibility to help his struggling community.

    “I can’t really say,” he said quietly. “I’m not into politics to tell you the truth. I was when I was younger, back in the ’80s.”

    Now, he lives the simplest of lives.
