The Competitive Enterprise Institute has obtained internal EPA e-mails that show the agency willfully and recklessly disregarded scientific data that undermined the bureaucracy’s global warming zealotry.


This information is especially relevant as Congress rushes to pass the cap-and-trade nightmare on Friday.

CEI general counsel Sam Kazman has notified the EPA and requested that the internal communications and suppressed study be released to the public and added to the public record. Will another whistleblower be disappeared? Note especially this warning to the dissenting scientist: “The time for such discussion of fundamental issues has passed for this round. The administrator and the administration has decided to move forward on endangerment, and your comments do not help the legal or policy case for this decision… I can only see one impact of your comments given where we are in the process, and that would be a very negative impact on our office.”

CEI is submitting a set of four EPA emails, dated March 12-17, 2009, which indicate that a significant internal critique of EPA’s position on Endangerment was essentially put under wraps and concealed. The study was barred from being circulated within EPA, it was never disclosed to the public, and it was not placed in the docket of this proceeding. The emails further show that the study was treated in this manner not because of any problem with its quality, but for political reasons.

CEI hereby requests that EPA make this study public, place it into the docket, and either extend or reopen the comment period to allow public response to this new study. We also request that EPA publicly declare that it will engage in no reprisals against the author of the study, who has worked at EPA for over 35 years.

The emails, attached hereto, consist of the following:

1) a March 12 email from Al McGartland, Office Director of EPA’s National Center for Environmental Economics (NCEE), to Alan Carlin, Senior Operations Research Analyst at NCEE, forbidding him from speaking to anyone outside NCEE on endangerment issues;

2) a March 16 email from Mr. Carlin to another NCEE economist, with a cc to Mr. McGartland and two other NCEE staffers, requesting that his study be forwarded to EPA’s Office of Air and Radiation, which directs EPA’s climate change program. The email notes the quantity of peer-reviewed references in the study, and defends its inclusion of new research as well. It states Mr. Carlin’s view that “the critical attribute of good science is its correspondence to observable data rather than where it appears in
the technical literature.” It goes on to point out that the new studies “explain much of the observational data that have been collected which cannot be explained by the IPCC models.” (Emphases added);

3) a March 17 email from Mr. McGartland to Mr. Carlin, stating that he will not forward Mr. Carlin’s study. “The time for such discussion of fundamental issues has passed for this round. The administrator and the administration has decided to move forward on endangerment, and your comments do not help the legal or policy case for this decision… I can only see one impact of your comments given where we are in the process, and that would be a very negative impact on our office.” (Emphasis added);

4) a second March 17 email from Mr. McGartland to Mr. Carlin, dated eight minutes later, stating “ I don’t want you to spend any additional EPA time on climate change.”

Mr. McGartland’s emails demonstrate that he was rejecting Mr. Carlin’s study because its conclusions ran counter to EPA’s proposed position. This raises several major issues.

A. Incompleteness of the Rulemaking Record: The end result of withholding Mr. Carlin’s study was to taint the Endangerment Proceeding by denying the public access to important agency information. Court rulings have made it abundantly clear that a rulemaking record should include both “the evidence relied upon [by the agency] and the evidence discarded.” Ethyl Corp. v. EPA, 541 F.2d 1, 36 (D.C. Cir. 1976), cert. denied, 426 U.S. 941 (1976).

B. Prejudgment of the Outcome of the Endangerment Proceeding: The emails also suggest that EPA has prejudged the outcome of this proceeding, to the point where it arguably cannot be trusted to fairly evaluate the record before it. Courts have recognized “the danger that an agency, having reached a particular result, may become so committed to that result as to resist engaging in any genuine reconsideration of the issues.” Food Marketing Institute v. ICC, 587 F.2d 1285, 1290 (D.C. Cir. 1978).

C. Violations of EPA’s Commitment to Transparency and Scientific Honesty: Finally, the emails suggest that EPA’s extensive pronouncements about transparency and scientific honesty may just be rhetoric. Shortly before assuming office, EPA Administrator Lisa Jackson declared: “As Administrator, I will ensure EPA’s efforts to address the environmental crises of today are rooted in three fundamental values: science-based policies and programs, adherence to the rule of law, and overwhelming transparency.” Jan. 23, 2009, link. See also Administrator Jackson’s April 23 Memo to EPA Employees, “Transparency in EPA’s Operations”. These follow the President’s own January 21 memo to agency heads on “Transparency and Open Government”. And in an April 27 speech to the National Academy of Sciences, the President declared that, “under my administration, the days of science taking a back seat to ideology are over.”

Because of ideology, however, it was this back seat to which Mr. Carlin’s study was relegated; more precisely, it was booted out of the car entirely.

For these reasons, we submit that EPA should immediately make Mr. Carlin’s study public by entering it into the Endangerment docket, and that it should either extend or reopen the comment period in this proceeding to allow public responses to that study. It should do so, moreover, while publicly pledging that Mr. Carlin will suffer no adverse repercussions from agency personnel. Mr. Carlin is guilty of no wrongdoing, but the tenor of the emails described above suggests he may well have reason to fear reprisals.

    I think that everyone should consider carefully the consequences of not doing something. Do you really want to tell your grandkids that you helped to defeat an effort to give their generation a new lease on survival? If you even have an inkling of doubt, I would suggest that you support efforts to stem the damage our society is wreaking on our planet.

    I don’t know how any rational person would disregard the majority of scientists who agree that human activity contributes to global warming. I understand the economic impacts will be severe. But think about the economic impacts of Katrina, the tsunami, etc. Are you 100% sure (deep in your heart?) that our actions don’t contribute to global climate change?

    With that said, I am not sure I want to see this bill pass. Why? Because it will create such hostility and hate when people are impacted financially. I’m a cynic. I don’t value life like most do. So what if humanity dies? We are going to die sometime. I am ready to accept the fate that will come. I believe it will come soon…

    Public Shouldn’t Be Kept in the Dark by an Agency Supposedly Committed to Transparency

    Washington, D.C., June 26, 2009—The Competitive Enterprise Institute is today making public an internal study on climate science which was suppressed by the Environmental Protection Agency. Internal EPA email messages, released by CEI earlier in the week, indicate that the report was kept under wraps and its author silenced because of pressure to support the Administration’s agenda of regulating carbon dioxide.

    The report finds that EPA, by adopting the United Nations’ 2007 “Fourth Assessment” report, is relying on outdated research and is ignoring major new developments. Those developments include a continued decline in global temperatures, a new consensus that future hurricanes will not be more frequent or intense, and new findings that water vapor will moderate, rather than exacerbate, temperature.

    New data also indicate that ocean cycles are probably the most important single factor in explaining temperature fluctuations, though solar cycles may play a role as well, and that reliable satellite data undercut the likelihood of endangerment from greenhouse gases. All of this demonstrates EPA should independently analyze the science, rather than just adopt the conclusions of outside organizations.

    The released report is a draft version, prepared under EPA’s unusually short internal review schedule, and thus may contain inaccuracies which were corrected in the final report.

    “While we hoped that EPA would release the final report, we’re tired of waiting for this agency to become transparent, even though its Administrator has been talking transparency since she took office. So we are releasing a draft version of the report ourselves, today,” said CEI General Counsel Sam Kazman.

    It postures as an advocate of “sound science” in the development of public policy. However, CEI projects dispute the overwhelimng scientific evidence that human induced greenhouse gas emissions are driving climate change. They have a program for “challenging government regulations”, push property rights as a solution to environment problems, opposed US vehicle fuel efficiency standards and been a booster for the drug industry.

But if we let the “free market” regulate our behavior we are sure to destroy ourselves.     I liked him in his early days, but I was out of the mainstream during most of the 80’s and although you couldn’t miss michael, I didn’t obsess about him. No one can deny his talent. He was arguably the best dancer ever. The best entertainer ever. It is so sad that he was so messed up.

    The outpouring of emotions is a bit overwhelming and disconcerting. There was an ireport of a woman crying on video that made it “on cnn”. It was a bit much. I just saw punjabi on cnn giving his reaction. Our culture is consumed with pop icons….

    vf, as I told infoaddict on her ireport, I think calling it a tax is a bit misleading. We will not be taxed by the government directly. Utilities will pass on their increased costs. If we all conserve and cut our energy use, we can offset the increased rates.
    This is not a tax, it is an incentive to conserve, which is what I have been saying is needed for years.

    Here is one story.
    EPA Report Requires Clarification On Livestock Tax A recent Environmental Protection Agency rule-making report triggered much speculation and interpretation that the agency would likely impose a “tax” on livestock and dairy operations for methane emissions. The 570-page report’s objective was to outline ways to implement the Clean Air Act. It included sections related to reducing livestock methane emissions.
    However, EPA officials have stepped out to emphasize the report should not be interpreted that the agency will actually tax farmers for their livestock or dairy animals. Upon the report’s release, the agricultural community’s red flags quickly flew. For example, the American Farm Bureau Federation estimated the report’s exploration of farmers with 25 dairy cows or 50 beef cattle would be expected to buy permits for each ton of methane those animals released, and that it could cost farmers $175 per dairy cow and $87.50 per beef cow annually. AFBF circulated a document outlining this prospect.
    EPA has since released a statement, saying that it is currently reviewing public comments on proposed rule changes to the Clean Air Act. The agency said, however, that it is not proposing a “cow tax” as a way to regulate greenhouse gas emissions. Click here to read EPA’s statement.     Here is another story. MONTGOMERY, Ala.— A new proposal by the Environmental Protection Agency would devastate Alabama’s multi-million dollar livestock industry and cause food prices to escalate, according to officials with the Alabama Farmers Federation, the state’s largest agricultural organization. The proposal is essentially a tax on livestock operations, said Perry Mobley, director of the Federation’s Beef Division. The American Farm Bureau Federation, which includes the Alabama Farmers Federation, has registered its opposition to the proposal aimed at regulating greenhouse gases under the Clean Air Act. “Most livestock and dairy farmers would not be able to pass along this tax,” Mobley said. “If this proposal is finalized, it would put many producers out of business and would likely result in higher consumer costs for milk, beef and pork.” EPA is seeking public comments until Nov. 28, and the Federation is urging its members to oppose the measure by contacting EPA officials. Comment information is available on the Federation’s Web site at http://www.AlfaFarmers.org under Action Alert. According to U.S. Department of Agriculture figures, any farm or ranch with more than 25 dairy cows, 50 beef cattle or 200 hogs emits more than 100 tons of carbon equivalent per year, and thus would need to obtain a permit under the proposed rules.
    More than 90 percent of U.S. dairy, beef and pork production would be affected by the proposal. Mobley said the figure could be even higher for Alabama. Permit fees would vary from state to state, but EPA sets a “presumptive minimum rate” for fees. For 2008-2009, the rate is $43.75 per ton of emitted greenhouse gases. According to AFBF, the proposed fee would mean annual assessments of $175 for each dairy cow, $87.50 for each head of beef cattle and $20 for each hog. “Reduction of a ton of greenhouse gases anywhere will make a difference, but if a ton is removed in Iowa and replaced by a ton in China, then no net effect occurred,” said Mark Maslyn, AFBF executive director of public policy. ”
    A livestock tax and regulation of greenhouse gases under the Clean Air Act will impose restrictions and added costs on the U.S. economy without reducing greenhouse gases in the atmosphere.” Mobley said the proposal is unclear as to how the money would be collected, and although the rule is simply a proposal right now, this is the first step toward making it a permanent requirement for producers.

    This is months old, but here is a HINT of future events we can believe in:
    This is already being done in Europe. I personally don’t think parents would like for their own flesh and blood to be “reporting” them to the powers that be in government, do you?

    The “Climate Cops” website encourages children to investigate family and friends and “then build your ‘Climate Crime Case File’ and report back to your family to make sure they don’t commit those crimes again (or else)!” The site also warns children that they “may need to keep a watchful eye” to prevent future violations.

    A link on the site for teachers to download free materials for building lesson plans indicates the website is targeting children from ages 7-11.

    The so-called crimes children are to watch for are listed on a poster (visible at right) and range from leaving the tap running and failing to use energy-saving light bulbs to running the dryer on a sunny day and putting hot food in the refrigerator.

    The website also encourages children to download a series of “Climate Crime Cards” (such as the one pictured below) in which enlisted “Climate Cops” can keep an ongoing record of their family’s violation of energy “crimes.”

    Recruiting children to spy on and keep records of their parents’ infractions reminds some of Adolf Hitler’s Nazi youth program, only with an environmentalist bent. The author of the blog EU Referendum wrote: “In a system which has echoes of Hitler’s Deutsches Jungvolk movement … perhaps successful graduates can work up to becoming block wardens, then street and district ‘climate crime Fuehrers,’ building a network of spies and informers.”

    Hitler’s youth program, which began in the 1920s and ended in 1945, enlisted children to be trained in the ideals of the Nazi party.     When I was 4 I brought home some “toadstools” in a pail for my mom. She asked if I ate any and I said “yeah” She asked how many and I held up 4 fingers. If she had asked me my age I woulda held up 4 fingers. I don’t think I ate 4 mushrooms, but my precious little life was too sacred to risk losing so I was taken to the hospital and tubes were shoved up my nose and vomit projected from my mouth (I insisted that I vomited into a nurses face, that is a family legend. heehee).

    I wouldn’t eat a mushroom for another 14 years, but have grown to love them.

    sami, I usually use morel mushrooms which proliferate in the Spring in forest fire areas. You wouldn’t believe what people pay for those mushrooms. One year I was buying them from pickers for $3.50/lb and selling them for $22-$35/lb plus air freight on ebay. It was difficult to pack them and ship them fresh, but well worth the money. And guess what? it was all tax free! hahaha
    Anyone who doesn’t realize that I am a capitalist at heart, doesn’t really know me. I have been an entrepeneur most of my life, just not very ambitious. I got that from my dad.     WASHINGTON – WND Editor and Chief Executive Officer Joseph Farah is offering a $10,000 reward to anyone who can prove he or she was present at the birth of Barack Obama – and he’s asking Americans to donate to the cause in hopes of raising the bounty to an irresistible amount.

    “Barack Obama claims to have been born in Honolulu Aug. 4, 1961,” explains Farah. “His entire constitutional claim to the presidency rests on this premise. Yet, he refuses to release a copy of his long-form birth certificate – the only document that could possibly corroborate his claim. Therefore, in the interest of truth, justice and the Constitution, I am making the extraordinary offer to entice someone to come forward with the facts of his birth – whether it took place in Hawaii or elsewhere.”

    Obama has steadfastly refused to release evidence of that Hawaiian birth – a valid, long-form birth certificate that would show details of the birth, such as the hospital and the attending physician. Because the short-form “certification of live birth” he released to select news organization was at least sometimes issued for foreign births on the basis of an affidavit by one parent, it proves nothing as far as constitutional eligibility – and, in fact, raises suspicions about a foreign birth.

    To date, no hospital in Hawaii has come forward to claim this historic birth.

    No doctor or nurse has come forward to say they were present for that historic birth.

    No witness of any kind has come forward to say they have first-hand knowledge or involvement in that historic birth – at least in Hawaii.

    Obama’s paternal grandmother, Sarah Obama, claims to have been present for the birth in Mombassa, Kenya.

    “It is clear now that Obama will never willingly release his birth certificate,” said Farah. “It’s time for Americans who still value the Constitution to step up and force the issue. It’s time for us to learn the truth of where Obama was born. We may find he was born in Hawaii. We may find he was born elsewhere. I have no pre-conceived ideas. But this issue has haunted the American people long enough. It’s time for some truth and transparency.”

    To collect the reward, the subject must:

    1. Agree to an interview with WND journalists;

    2. Provide persuasive evidence, such as pictures, documents or verifiable details;

    3. Agree to a polygraph test.

    “I think it’s disgraceful that Americans should be forced to go to such lengths by the intransigence of public officials toward accountability,” said Farah. “But that is what it has come to in 2009 with our current president. He prefers to dodge and weave, while his apologists in government and media viciously attack citizens for attempting to see that the Constitution is observed.”

    Farah launched a petition drive earlier this year that has accumulated nearly 400,000 signatures demanding that all controlling legal authorities pursue proof of Obama’s status as a “natural born citizen.” That petition campaign is still on-going.

    More recently, he launched a billboard campaign raising the simple question, “Where’s the birth certificate?” That campaign has raised $85,000 so far. Farah says there are plenty of billboards available, despite a ban on the campaign by several major outdoor advertising companies. But donations have dried up because of an apparent misperception among readers that billboards are not available due to the bans imposed by a few companies.

    In addition, Farah points out those interested in backing his latest campaign can also raise visibility for the issue by purchasing magnetic bumper stickers, tea party rally signs and yard signs that raise the same simple question, “Where’s the birth certificate?”

    I really don’t think it will be that significant of a difference. I believe we may be able to prolong the inevitable. It could give us several more years, or decades even if we cut consumption. But what other’s have said is valid. If developing countries don’t join us, it’s futile. Perhaps so. So do we just stick with the status quo? Ok. I can live with that.

    Tea leaves not working so good tonite. Anyways, no telling what Senate’s going to do. Personally, I think recent icon deaths helped Obama to wag the dog on us. So I’m hoping the same will not be repeated when Senate votes.

    1. Snake eyes on Dem party for next go-round. Obama is a 1-termer, similar to Carter. Senate turns Dem. They will be on a losing streak at the crap table.

    2. Several (not positive) historical moments prior to 2012 election, that will re-define CHANGE.

    3. GOP star under cover, being groomed up. GOP star not on the radar at this time. Some suggest that its Mississippi governor. But he’s a smoke screen for cover of the GOP ONE.

    4. Though Dem wont get next presidency, another party (other than Repub.) will be formidable.

    There seems to be a consensus that because of the age of the older two children, the court will probably take into consideration the children s’ wishes. It is pretty much certain that Jackson’s parents will keep blanket.
